MEMORANDUM OPINION

This matter came on for hearing on March 13, 1996 on defendant's motion to dismiss the superseding indictment on double jeopardy grounds. For the reasons set forth below, the motion will be denied.

FACTUAL AND PROCEDURAL BACKGROUND

On December 26, 1994, United States Customs officials detained Melinda Rice at the St. Thomas airport after a routine inspection of her suitcase uncovered cocaine.
