Erom Clark Circuit Court; Jacob Herter, Special Judge. Action by Edward W. Kleespies against the Baltimore & Ohio Southwestern Railway Company. Erom a judgment on a verdict for plaintiff for $3,000, defendant appeals.

Action against appellant and the Pittsburgh, Cincinnati, Chicago & St. Louis Railway Company to recover damages for personal injuries sustained hy appellee through their alleged negligence. A trial by jury resulted in a verdict in favor of appellee as against appellant, and in favor of its codefendant. Appellant’s motion for a new trial was overruled, and judgment pronounced upon the verdict.

The Pittsburgh, Cincinnati, Chicago & St. Louis Railway Company, hereafter called the Pennsylvania company, is not made a party, but was served with notice of the appeal, and has filed a brief.…
