CHIPMAN, C.

Action against defendant Samuel Hewlett, as executor of the last will of Alonzo McCloud, deceased, and certain other defendants on the official bond of said executor.

It appears from the findings that said Alonzo died in 1893, and in his last will named defendant Samuel Hewlett and one R. D. Baldwin as executors, who were duly appointed and qualified as such executors August 5, 1893; executor Baldwin died October 7, 1897; upon qualifying as executor, said Hewlett executed the bond on which the suit is brought.
