This was an action by the appellees against the appellants upon a guardian’s bond'.

It is alleged in the complaint, that the appellant Francis V. Haynes was appointed guardian of the person and estate of the appellee Mary J. Swope, on the 5 th day of May, 1866, and, together with the other appellant, David Bailey, executed the usual bond and became her guardian, and entered upon the discharge of his duties and trust as such, under his appointment; that she was then fifteen years of age, and that about one year before the commencement of the action she intermarried with her co-plaintiff, Alfred…
