This is ah appeal from an order overruling defendant’s demurrer co .the plaintiff’s complaint. The action is for libel, and the only question presented is as to whether or not the complaint states facts sufficient to constitute ■ a. cause of action. The allegations of the complaint are, in substance, as follows: That the plaintiff is a resident of Lead City, and president of the Lead City Miners’ Union, an organization containing about 1,000 members, and that the defendant is engaged in the furniture business in said city, and includes in said business the sale of pianos.
