OPINION AND ORDER

This matter is before the Court on the parties cross-motions for summary judgment. (See Docs. 79 and 82). Responses have been filed and the motions are now ripe for review. For the reasons that follow, the Court GRANTS Defendant’s Motion for Summary Judgment and DENIES Plaintiffs Motion for Summary Judgment.
