THIS CAUSE came before the Court upon Defendant’s Motion to Dismiss the Second Amended Complaint (D.E.41).

I. Factual Background1

Plaintiff Scott Weinberger was employed as a Deputy Sheriff of Broward County, Florida.2 In addition to his law enforcement activities, plaintiff purportedly had an ongoing business and personal relationship with Mohammad Ali.
