The plaintiff sued to recover damages for the death of her husband on the ground of the alleged negligence of the defendant. The intestate had been for many years in the employ of the Pennsylvania Railroad Company prior to the time the operation of the company’s road was taken over by the Federal government. At the time of the accident resulting in his death he was yardmaster at the Gardenville yards of the defendant, just outside the city *566of Buffalo. The plaintiff charges negligence.
