Defendant, Glenn. Gene Rasler, appeals from convictions by a jury of aggravated assault (K. S. A. 21-3410) and unlawful possession of a firearm (K. S. A. 21-4204). Defendant was acquitted on a count of aggravated battery.

On March 18, 1973, about 1:30 a. m., Rodney Trowbridge and his family were driving south on 1-235 By-pass in Wichita when their automobile was side-swiped by a blue-green Pontiac.
