The plaintiff instituted this action to recover the sum of $700’, a balance claimed to be due under a written order made by one William Lyman, and accepted by defendant, for labor performed and materials furnished by plaintiff, arising out of the following facts: On or about May 8, 1907, defendant and the said Lyman entered into a written agreement, by the terms of which the defendant agreed to loan to the s-aid Lyman, and he agreed to accept, the sum of $80,-000 under a building loan agreement, secured by a mortgage executed by the said Lyman on the premises situated on the southeast corner…
