VALENTINE, J.:
This was an action of forcible detainer brought on March 12, 1888, before a justice of the peace of Atchison county by Rebecca Osborn against Charles Lyons, to recover certain real estate situated in said county. A trial was had before the justice and a jury, and judgment was rendered in favor of the defendant and against the plaintiff, and the plaintiff, as plaintiff in error, .took the case to the district court on petition in error, where the judgment of the justice of the peace was reversed; and afterward the defendant, as plaintiff…
