Defendant Transcontinental Insurance Company has filed a motion for partial summary judgment. Transcontinental argues that Wisconsin law applies to construction of its liability policy issued to defendant Briggs & Stratton (“B & S”), and that under Wisconsin law, remediation conducted by B & S pursuant to a United States Environmental Protection Agency (“EPA”) Order and Notice of Violation of the Georgia Department of Natural Resources Environmental Protection Division (“EPD”) does not constitute “damages” under the policy.
