GOFF, Circuit Judge.

This writ of error was prosecuted from a judgment rendered by the Circuit Court of the United States for the Southern District of West Virginia in an action of assumpsit. The declaration contains the usual indebitatus assumpsit counts. The case is sufficiently stated by the facts as found by the court below. By stipulation in writing the parties waived a jury, and submitted all matters of law and fact involved in the issues to the court for its decision.
