OPINION AND ORDER

NINA GERSHON, District Judge:

This opinion and order sets forth my findings of fact and conclusions of law following a hearing on charges that the defendant, Joshua Kestenbaum,. violated the conditions of his probation. The United States Probation Department for the Eastern District of New York charged in a probation violation report (“Violation Report”) that Mr. Kestenbaum violated mandatory conditions of his probation by: (1) providing false statements to the government and the Probation Department regarding his business enterprises and income in violation of 18 U.S.C. §…
