In an action to recover damages for personal injuries, etc., the defendant Jamaica Towing, Inc., appeals from an order of the Supreme Court, Queens County (Polizzi, J.), dated December 9, 1996 which denied its motion to dismiss the complaint insofar as asserted against it for the plaintiffs’ failure to comply with a conditional order of preclusion.

Ordered that the order is reversed, with costs, the motion is granted, the complaint is dismissed insofar as it is asserted against the appellant, and the action against the remaining defendants is severed.
