In two actions to recover damages for personal injuries, etc., the defendant Nelson Maintenance Services, Inc., appeals from so much of an order of the Supreme Court, Suffolk County (Tanenbaum, J.), dated October 19, 1992, as denied its motion for summary judgment dismissing the complaint in Action No. 1 insofar as asserted against it.
Ordered that the order is reversed insofar as appealed from, on the law, with costs, and the complaint in Action No. 1, is dismissed insofar as asserted against the appellant, and the action is severed as against the remaining defendants.
