This is an action brought under OCLA, § 107-212, as *366amended by chapter 234, Oregon Laws of 1941, by the State of Oregon against Peter Gonrley, Phillip Gonrley, and Levi Gourley, dba Gourley Brothers, a partnership hereinafter referred to as Gourley Brothers, and Empire Millwork Corporation, hereinafter referred to as Empire, to recover the cost of controlling and suppressing a forest fire. From a judgment for the defendants Empire and Gourley Brothers, plaintiff appeals.
