MEMORANDUM AND ORDER

This matter comes before the Court on defendant Jay Bey-Woodson’s Motion To Set Aside Entry Of Default (Doc. #37) filed October 16,1998.

Facts

On May 27,1998, Jay Bey-Woodson voluntarily entered an appearance in this action by filing his Notice Of Removal To The United States District Court For The District Of Kansas (Doc. # 1). After removal, defendant did not file an answer or any pre-answer motions under Fed.R.Civ.P. 12. Because of defendant’s inaction, the Court entered de*355fault against defendant on July 7, 1998. See (Doc. # 9).
