• THE COURT.

This cause was transferred to the district court of appeal for the second district. The justices of that court being unable to agree upon a judgment, the cause was duly transferred to this court for decision. The following opinion, prepared by Hon. Victor E. Shaw of that court and concurred in by Mr. Justice James, is adopted as the opinion and judgment of this court:
