QUIST, District Judge.

This Court has addressed several issues in the distribution of a wrongful death settlement amount in this 42 U.S.C. § 1983 action, with appended state tort and constitutional claims, brought on behalf of Norris Maben, deceased. Still pending before the Court is the issue of whether Norris Maben Jr., who was born after Norris Maben was killed, is the son of the decedent and, if so, whether he can receive wrongful death damages.
