—Order, Supreme Court, New York County (Barry Cozier, J.), entered March 23, 2001, which granted plaintiffs motion for partial summary judgment on the first cause of action pursuant to CPLR 3001 and denied defendant’s cross motion to dismiss the complaint, unanimously reversed, on the law, without costs, plaintiffs motion denied, defendant’s cross motion granted, and the complaint dismissed in its entirety. The Clerk is directed to enter judgment in favor of defendant-appellant dismissing the complaint as against it.
