OPINION OF THE COURT

FREEDMAN, Circuit Judge.

This is an action brought by a prisoner under the Civil Rights Act, 42 U.S.C. § 1981 et seq., claiming that he is being unconstitutionally discriminated against in his efforts to acquire certain books and publications for study. Plaintiff accompanied his complaint with a petition for leave to proceed in forma pauperis.

The District Court did not find the affidavit of poverty inadequate, but believing the cause of action to be “without merit whatsoever” entered an order denying the petition for leave to proceed in forma pauperis. See 28 U.S.C. §…
