SHEPHERD, Circuit Judge.

Jerome Davis was convicted in the Hen-nepin County, Minnesota District Court of aiding and abetting first-degree felony murder and sentenced to life in prison. In his direct appeal to the Minnesota Supreme Court, Davis claimed, inter alia, that the state trial court erred when it admitted a statement he made to police while in custody because the police violated his Fifth Amendment right to remain silent. The Minnesota Supreme Court concluded that any error committed by the trial court was harmless beyond a reasonable doubt. Davis filed a petition for writ of habeas…
