ORDER GRANTING DEFENDANT’S MOTION FOR SUMMARY JUDGMENT
KENT, District Judge.
In this action, Plaintiff Informed Citizens United, Inc., (“ICU”) brings a citizen suit under the Clean Water Act, 33 U.S.C. §§ 1251, et seq., against Defendant USX Corporation (“USX”). ICU alleges that USX violated the terms of a permit issued by the U.S. Army Corps of Engineers which authorized USX to discharge dredged or fill material onto certain wetlands owned by USX.
