MEMORANDUM OPINION AND ORDER RE: PLAINTIFF’S MOTION FOR PRELIMINARY INJUNCTION; CROSS-MOTIONS FOR SUMMARY JUDGMENT

I. INTRODUCTION
On December 12, 1996, Plaintiff Chevron, U.S.A. Production Co. (“Chevron”) filed a complaint against the government 1 to compel agency action. On December 19, Chevron filed a motion for a preliminary injunction, which it sought to have heard on shortened time. See Pl.’s Ex Parte Application for Order Shortening Time.
