This is an appeal by the defendant from denial of his pre-trial motion to dismiss an indictment which charged that on October 27, 1952 he knowingly and wilfully failed and neglected to report for induction into the armed forces of the United States in violation of 50 U.S.C.A. Appendix, § 462.
