People v. Cooksey

Appellate Court of Illinois

Decided December 22, 1999No. 1-97-2689PublishedCited by 37 opinions

1Opinion of the CourtJustice Burke

Following a jury trial, defendant Toijuan Cooksey was convicted of robbery (720 ILCS 5/18 — 1 (West 1996)) and vehicular hijacking (720 ILCS 5/18 — 3 (West 1996)) and sentenced to concurrent terms of 7 years’ and 10 years’ imprisonment, respectively. On appeal, defendant contends that the State failed to bring him to trial within 120 days, in violation of the Code of Criminal Procedure of 1963 (725 ILCS 5/103 — 5 (West 1996)) and to prove him guilty beyond a reasonable doubt of robbery and vehicular hijacking. For the reasons set forth below, we affirm in part and reverse in part.
