This matter is before us on the appeal of defendant-appellant, Fran Plum, d.b.a. Heidi’s, from a judgment of the Franklin County Court of Common Pleas overruling defendant’s Civ. R. 60(B) motion for relief from judgment. Summary judgment has been rendered below on issues of liability and damages in favor of plaintiff-appellee, U.A.P. Columbus JV326132, d.b.a. Lane Avenue Shopping Center (lessor).
