Morrison, C. J.:

The defendant was prosecuted in the Superior Court of Tehama county for the crime of robbery, and having been convicted of that crime, appealed to this Court, and asks a reversal of the judgment of the Court below on three grounds, which we proceed to examine.

1. The first objection is to the verdict, which is as follows; “We, the jury, find the defendant guilty as charged in the information.” It is claimed that the crime of robbery charged in the information also involved the crime of grand larceny, of which it was within the power of the jury to find the defendant guilty, and…
