CHOATE, District Judge.
This is a libel by Edward F. Davison and others against the brig Sloga for failure'to deliver in good order and condition a cargo of sugar shipped at Pernambuco under charter and bill of lading, which excepted only “all the dangers and accidents of the seas and navigation of whatsoever kind.” The vessel left Pernambuco on the 13th of November, 1873, having shipped 5,100 bags of green sugar consigned to ■ the libellants.
