1. On the trial of one indicted for the offense of murder the court instructed the jury as follows: “If the State has proven these beyond a reasonable doubt, each and every one of these material allegations I have called your attention to, the defendant on trial will then •be guilty of the offense of murder, and you should so say by your verdict.” The ground of complaint is that the charge as given deprived the defendant of the benefit of the defenses urged by him upon Ms trial, *307The charge followed a correct enumeration of the necessary and essential allegations ir the indictment, and a clear…
