1. In the first ground of his amendment to his motion for new trial the defendant alleges that the court erred in refusing to *290permit W. T. Brooks, a witness for the State, to answer a question propounded to him by counsel for the defendant. This witness was asked if the defendant, on entering the place of business of the deceased on the occasion of the homicide, did not appear to be speaking good naturedly and in good humor, and was smiling, when he addressed the deceased and those with the latter.
