This was an action of replevin commenced by Samuel H. Bonns against' William H. Carter, sheriff of Cherry county. The property replevied consisted of a stock of merchandise formerly owned by, and in the possession of, B. C. Hamilton, but which had been conveyed by him to *567Samuel H. Bonns by an instrument claimed to be a chattel mortgage, and which had been afterwards levied upon and taken from the possession of said Bonns by the said sheriff, upon an ■ order of attachment issued in an action pending against Hamilton, and in favor of one of his Creditors.
