It should first be stated that we have carefully examined and analyzed the record, and, while we would not be disposed to disturb the verdict and judgment on the weight of the evidence, we have carefully examined this record with a view of determining whether the proper rule as to the weight of evidence and degree of proof has been applied. We are convinced by such examination and analysis that there is no doubt that Sabo lay in wait for G-ruich and that he shot and killed Painter, believing him to be G-ruich.
