This suit was brought by appellee to recover the sum of $1,000 alleged to be compensation due him by appellant under the Workmen's Compensation Act of this state (Acts 1913, c. 179 [Vernon's Sayles' Ann.Civ.St. 1914, arts. 5246h-5246zzzz]).

The petition alleges in substance that plaintiff was injured on April 29, 1916, while working for the Kirby Lumber Company at a weekly wage of $10.50; that defendant was the insurer of said lumber company under the Texas Workmen's Compensation Act; that the Industrial Accident Board had investigated his claim for compensation, and had decided that he was…
