The defendant-appellant, Luis Ramirez Ferrer, was convicted by a jury in the United States District Court for the District of Puerto Rico on two counts of unlawfully erecting a building on navigable waters of the United States without securing a permit from the United States Army Corps of Engineers (hereinafter “the Corps”) in violation of 33 U.S.C. §§ 403, 406.
