Appeal by the defendant, Henry A. Siebrecht, from a judgment of the County Court of Westchester county in favor of the plaintiff, entered in the office of the clerk of said county on the 12th day of January, 1912, upon the verdict of a jury,, and also from an order entered in said clerk’s office on the 9th day of February, 1912, denying the defendant’s motion for a new trial made upon the minutes.

Woodward, J:

The plaintiff is a daughter-in-law of the defendant, and brings this action to recover two items, one of $700, alleged to have been loaned to the defendant on the 10th day of January, 1906-, and the other for $353.17, alleged to have been loaned September 28, 1907. She has recovered for the full amount of both claims, and the defendant appeals from the judgment *228and from the order denying his motion for a new trial on all of the grounds specified in section 999 of the Code of Civil Procedure.
