[1] Plaintiff below, defendant in writ, has moved to dismiss the present application for writ, on the ground that section 2 of rule 16 of this court (67 South, xi 1), requiring a notice of the intention to apply for a writ of this kind to be filed in the “clerk’s office of the Court of Appeal,” has not been complied with.

The Court of Appeal has no other clerk than as provided in article 106 of the Constitution as amended (Act 137 of 1906), to wit:

“The clerk of the district court of the parish in which the sessions of the Courts of Appeal are held, shall serve as clerk” thereof.
