This is a suit to recover possession of certain real estate, and damages for the detention of the same.

The defendant answered in two paragraphs. First, a general denial, and second, that the plaintiff claims title by-virtue of a deed from the Sheriff of Marion county upon the • foreclosure of a mortgage given by the defendant to one Timothy Splahn; that the mortgage was drawn up by Christopher Werbe, and William V.
