This suit was instituted by G. D. Oldham against W. G. Briley for the cancellation of nine vendor’s lien notes, (and a deed of trust securing the payment of same) aggregating the principal sum of $3909.26, executed by' Oldham and payable to the Citizens National Bank of Abilene, Texas, hereinafter called “the bank” or the “Abilene bank.” Cancellation of the vendor’s lien is also sought.
