MEMORANDUM OPINION

JAMES C. CACHERIS, District Judge.

This matter comes before the Court on the parties’ cross-motions for summary judgment. For the reasons stated below, the Court will deny Plaintiffs motion for summary judgment and deny Defendant’s motion for summary judgment. As further explained infra at subpart III.C, the Court finds that each party has failed to put forward sufficient evidence to receive the relief it requests. The Court will leave the parties as they stand.
