Theodore Calloway, while working in the mine of the Octavia J. Coal Mining Company, died on February 14, 1928. Both he and the company had accepted the provisions of the "Workmen’s Compensation Act (Ky. Stats., sec. 4880 et seq.). Within due time his three-sisters and brother applied for compensation, which was deniqd by the Workmen’s Compensation Board. On, petition for review to the Pike circuit court the action of the board was set aside and the claimants were awarded $4,000. On appeal the judgment was reversed, on the ground that the board made…
