OPINION

BRUCE I. POX, Bankruptcy Judge:

Before me for resolution is an adversary proceeding brought by William Pox against the debtor, asserting the nondischargeability in bankruptcy of a debt owed to him. The plaintiff argues that the debt is nondis-chargeable pursuant to the provisions of 11 U.S.C. § 523(a)(4) and (a)(6). The joint pretrial statement had made reference to § 523(a)(2), but at the hearing on this matter it expressly was agreed that this subsection is not a basis upon which the plaintiff desired to proceed.
