In the city of Louisville, on tbe 21st day of December, 1868, appellant drew his check on Tucker & Co., bankers in said city, for three hundred dollars in current funds, payable to appellee or order in satisfaction of a debt the former owed the latter.

On the day after said check was drawn it was taken to the house of Tucker & Co. by appellee to demand and receive payment thereof; but the house during the whole of that day was closed, and never has been opened by them as a business-house since; they having become insolvent, and having taken the…
