This was an action of ejectment in the common-law form. The trial resulted in a verdict for the defendants. The *36plaintiff assigned error upon a refusal to grant a new trial, and upom certain exceptions pendente lite.

1. The original defendants were E. A. Cohen, Nancy Overstreet, and Julian Ehrlich. They all appeared and filed a plea of the general issue. 'Subsequently the plaintiff dismissed the action as to» Nancy Overstreet. After the order of dismissal had been taken, Nancy Overstreet filed an application asking that she be reinstated, as a party defendant to the case. This motion was…
