OPINION REGARDING DEFENDANT’S MOTION FOR SUMMARY JUDGMENT

Introduction

Frank Lopez filed for chapter 7 bankruptcy relief on May 4, 2001. Sandra Donaldson commenced this adversary proceeding against him. She alleges that the Defendant “committed the tort of intentional infliction of emotional distress against” her, and that the resulting debt “is non-dischargeable in bankruptcy, since it is [for] ... a wilful and malicious injury.” Complaint at ¶¶ 4 & 6.
