These parties appeared in reverse order in the trial court and are hereinafter referred to as there, or by name.

Plaintiffs brought this action against defendant and some eight others, including Esther Serfosa, to quiet title to a certain lot in Denver. Godfrit alone defended. He also filed a bill of particulars and answers to nine interrogatories propounded under Rule 33, R.C.P. Colo., ’35 C.S.A. vol. 1, p. 136. Plaintiffs’ motion for summary judgment was granted and decree entered for them. To review that judgment defendant prosecutes this writ, specifying five alleged errors. Since these…
