On November 8, 1917, Charles Fuller, twenty years of age, an employee of the Chicago, Rock Island & Pacific Railway Company, received an injury arising out of and in the course of his employment. In February, 1918, the company filed in the district court an application for the appointment *609of an arbitrator to determine the amount to which he was entitled under the workmen’s compensation act.
