Brassica Protection Products LLC v. Caudill Seed & Warehouse Co.
District Court, S.D. New York
1Opinion of the Court
OPINION AND ORDER
SHIRA A. SCHEINDLIN, District Judge:
I. INTRODUCTION
Brassica Protection Products LLC (“Brassica”) and the Johns Hopkins University (“Johns Hopkins”) allege that Cau-dill Seed & Warehouse Co., Inc. (“Caudill”) infringed certain of their patents directed to the preparation of food products containing specific chemoprotective compounds. Despite the termination of a pri- or sub-license agreement between Brassica and Caudill, plaintiffs contend that Caudill has continued to produce, distribute, offer to sell, and sell products covered by the patents without authorization to do so.
