This is a motion by defendant Port Authority Trans-Hudson Corporation (“Path”) to dismiss the action for lack of jurisdiction over the subject matter. Fed.R.Civ.P. 12(b) (1). For reasons to be set forth, the motion must be denied.
Path is a subsidiary corporation of The-Port of New York Authority (the “Authority”), which Authority is a body corporate created by compact between the-States of New York and New Jersey, with the consent of Congress (42 Stat. 174).
